The judicial commission report on the November 2024 Sambhal violence has emerged as a fresh political flashpoint in Uttar Pradesh, with the Bharatiya Janata Party (BJP) using its findings to target the Samajwadi Party (SP) ahead of the state assembly elections due early next year. The report, tabled in the Uttar Pradesh Legislative Assembly on August 5, concludes that the violence was “pre-planned”, gives a clean chit to the police and district administration, and points to the alleged involvement of SP leaders in the law and order breakdown.

Jain and former IAS officer Amit Prasad were the other members of the panel, which was constituted by the Uttar Pradesh government following the violence.

The commission examined the circumstances surrounding the clashes that broke out in Sambhal during the second phase of a court-ordered survey of the Shahi Jama Masjid in Chandausi town. The judicial commission concluded that the police and district administration responded in a restrained and appropriate manner during the violence. According to the report, there was no evidence to suggest that the bullets which killed the four victims were fired from police weapons.

The panel also noted that 28 police personnel were injured during the clashes, including seven officers who sustained bullet injuries. The report stated that members of the crowd allegedly attempted to snatch police weapons, attacked government officials and damaged public property while law enforcement personnel tried to control the situation.

He further claimed that material already exists suggesting that some police officials in Sambhal had political links with the BJP while serving in uniform. According to him, the people of Sambhal neither accepted nor participated in communalism.

The BJP has defended the commission’s findings, maintaining that the report was prepared after examining all available evidence. Party spokesperson Rakesh Tripathi said the conclusions were supported by a thorough investigation.

“These findings are based on a thorough investigation and are backed by evidence. The report clearly shows the involvement of SP leaders and how they attempted to incite violence. Their objective was to use Sambhal to destabilise the Yogi Adityanath government and trigger wider unrest across western UP. However, the local administration acted in time and foiled those attempts,” Tripathi said.
